Rental agreement

These terms are current as of 20 September 2026 and apply to every reservation made from that date.

These Terms and Conditions set out the obligations of Palmetto Bay Getaway LLC to the Renter, and of the Renter to Palmetto Bay Getaway LLC. In the event of a dispute, they are the basis for any resolution.

Please read this before making your reservation.

The property

A single private house in Palmetto Bay, Miami-Dade County, Florida, with three bedrooms, two full bathrooms and one half bathroom, a private heated pool in a fenced garden, a screened porch, and an air-conditioned garage fitted as a home gym. The street address is sent to you when your reservation is confirmed.

• Check-out: by 10:00 AM
• No early check-in or late check-out without prior approval from Palmetto Bay Getaway LLC.

Acceptance of these Terms and Conditions forms a contract between two parties: the Rental Applicant (the Lead Renter) and Palmetto Bay Getaway LLC.

1. Party members

The Lead Renter and the Rental Group are bound by this agreement. The Lead Renter assumes full responsibility for every member of the Rental Group throughout the rental period. The Rental Group means the authorised occupants named on the booking — family or friends of the Lead Renter. Use of the property is denied to anyone else. Should any unauthorised person occupy or use the property, the Lead Renter and all occupants shall vacate immediately without refund. All information and instructions about the rental are given to the Lead Renter and to no third party.

2. Minimum age

The Lead Renter must be at least twenty-five (25) years of age and must occupy the house for the entire rental period. No access code is issued to anyone under twenty-five who is not accompanied by a parent or guardian. Palmetto Bay Getaway LLC reserves the right to refuse service.

3. Occupancy

The maximum number of overnight guests is six (6) persons, children included. The agreed occupancy on the booking covers all persons of any age, day guests and overnight guests alike. Exceeding the agreed number will result in immediate eviction without refund, or a charge of double the nightly rate and the cleaning fee.

Daytime visitors are limited to two (2) persons, permitted on the property between 8:00 AM and 10:00 PM. The Lead Renter must ask in advance if more are expected.

4. Assignment and subletting

The Lead Renter shall not assign or sublet the property, or permit its use by anyone who is not a member of the Rental Group named on the booking.

5. Cameras

There are exterior cameras covering the driveway, the front entry and the side gate. They record for security and to verify occupancy under this agreement. There are no cameras inside the house, and none covering the pool, the fenced garden or the screened porch - the side gate camera faces the gate and the driveway only. Footage is not shared. Disabling, redirecting or obscuring a camera is prohibited and ends the stay immediately without refund. Guests are responsible for their own security while on the property by locking doors, windows and vehicles.

6. Payments

As set out on the Payment page of palmettobaygetaway.com, and repeated here:

A reservation is confirmed by Palmetto Bay Getaway LLC once we have accepted your dates and your first payment has cleared. That first payment is a rental deposit, not a security or damage deposit.

• Booked sixty (60) days or more before arrival, for seven nights or longer: fifty percent (50%) of the booking total

at booking, a further twenty-five percent (25%) sixty (60) days before arrival, and the balance thirty (30) days before arrival.

• Booked less than sixty (60) days before arrival, or for fewer than seven nights: the booking total in full at

booking.

• Payment is made by a major credit card on a secure checkout page. We never ask for card details by email or by

telephone.

• If we cannot accept your reservation, everything you have paid is refunded immediately.
• No stay begins until payment has cleared in full. If a payment is late or a card is declined, the reservation may

be cancelled and anything already paid is treated under the cancellation terms below.

7. Cancellation

Once a reservation has been accepted and confirmed, a cancellation can only be made in accordance with these terms:

• Cancelled sixty (60) days or more before the arrival date: one hundred percent (100%) of the rental amount is

refunded.

• Cancelled thirty (30) or more days, but fewer than sixty (60) days, before the arrival date: fifty percent (50%) of

the rental amount is refunded.

• There are no refunds for reservations cancelled within thirty (30) days of the arrival date.
• Early departure does not warrant any refund.

8. Damage waiver

A one-time, non-refundable Damage Waiver Fee of $50 is charged with each booking. It covers unintentional damage to the property or its contents during your stay, up to $500.

It does not cover intentional damage, gross negligence, damage by an animal, re-keying, damage caused by a motor vehicle, additional cleaning where the house is left excessively dirty, or invoices for damage presented after your occupancy. Where loss or damage exceeds the limit, Palmetto Bay Getaway LLC will bill the Lead Renter for the difference and may pursue any legal remedy for the amount owed. The waiver does not cover damage that is not disclosed: the Lead Renter must report any loss or damage immediately, so that nothing is blamed on the wrong guest. Palmetto Bay Getaway LLC determines the nature, extent and cost of any damage.

9. The pool

The house has a private heated pool in a fenced garden. There is no lifeguard. Use of the pool and the garden is entirely at your own risk.

• Children must be supervised by a responsible adult at all times in and around the pool. Never leave a child

unattended near water, even for a moment.

• The garden is fenced and its gate is self-closing and self-latching. Do not prop the gate open, and check that it

has latched behind you.

• No diving, and no jumping from furniture or the pool edge.
• No glass of any kind in the pool area.
• Do not swim alone, and do not swim under the influence of alcohol or drugs.
• The pool is heated on request. Tell us before you arrive if you would like the heat on; bringing a pool to

temperature takes many hours, so it cannot be arranged on the day.

• Do not add anything to the water and do not adjust the pool equipment or chemicals.
• Report anything wrong with the pool, the fence or the gate immediately.

The Lead Renter and the Rental Group accept these risks for themselves and for every member of their party, including children and visitors.

10. The garage gym

The garage is air-conditioned and fitted with exercise equipment (a treadmill, a rower and suspension straps). Equipment is provided as-is. You must inspect it before use and satisfy yourself that it is safe and suitable for you. Use it at your own risk, do not exceed its rated capacity, and do not allow children to use it. Palmetto Bay Getaway LLC is not responsible for any injury arising from its use. Report any fault immediately.

11. Condition and use of the property

The house is inspected before your arrival. The Lead Renter undertakes to:

• report any damage or maintenance issue immediately;
• keep the house and all furniture, fixtures and effects in the condition in which they were found;
• keep windows and doors closed in bad weather;
• follow the departure instructions provided;
• keep the air conditioning no lower than 72°F and the heat no higher than 78°F.

12. Pets

No animals of any kind may be brought onto the property, by the Lead Renter, the Rental Group or any visitor, without prior written permission. An unauthorised animal incurs a charge of $500, plus a pet cleaning fee of $250 and the cost of any damage or clean-up, and may end the reservation with eviction and no refund. Service animals are accommodated as required by law; please tell us in advance.

13. Smoking and vaping

This is a non-smoking property. No smoking or vaping of any kind is permitted indoors, on the porch, in the garage, in the garden, or anywhere on the property. Failure to comply incurs a charge of $500, may end the reservation with eviction and no refund, and leaves the Lead Renter liable for the cost of smoke removal from air conditioning ducts, filters, walls, ceilings and furnishings.

14. Candles and open flame

Candles, incense and any open flame are not permitted inside the house.

15. Parking

Parking is limited to two (2) vehicles in the driveway, including the vehicles of any daytime visitor. No parking on the swale, the sidewalk or the lawn, and no overnight parking on the street. No recreational vehicle, commercial vehicle, boat, jet ski, watercraft or trailer may be parked or stored on the property without prior permission. Illegally parked vehicles are subject to towing at the owner's expense.

16. Noise and conduct

Please be considerate of the neighbours. Excessive noise — voices, music, amplified sound — is not permitted. Quiet hours are 10:00 PM to 8:00 AM. No parties or events. The property may not be used for any unlawful purpose; illegal drug use or abuse of any person ends this agreement immediately, with removal from the property and no refund.

17. Wildlife

Peacocks roam this part of Miami-Dade and are loud at dawn, particularly in spring. They are wild birds and are not under the control of Palmetto Bay Getaway LLC. No refund is given for their noise, nor for insects, weather, or any other natural feature of the location. Please do not feed them.

18. Housekeeping and departure

A cleaning fee is charged with each reservation. No housekeeping is provided during your stay unless arranged in advance. On departure: leave used beds unmade with the sheets on them, leave used towels in the bathroom, wash and put away all dishes and cookware, remove all food from the refrigerator and cabinets, and place all rubbish and recycling in the correct receptacles outside. Rubbish and recycling are collected on Tuesday and Friday mornings; please put the bins at the curb the evening before.

19. Starter supplies

The house is let on a self-catering basis. A starter supply is provided for each reservation: hand soap and shampoo, three rolls of toilet tissue per bathroom, dish soap, dishwasher tablets, laundry detergent, three bin liners, a roll of paper towel and coffee. Replacing these during your stay is the guest's responsibility.

20. Smoke alarms, carbon monoxide alarms and fire safety

Smoke and carbon monoxide alarms are installed. You may not remove, dismantle, cover or otherwise interfere with them, and must report any malfunction immediately. A fire extinguisher is provided in the kitchen; you may not misuse, test, dismantle, block or remove it, and any use must be reported so that it can be refilled. No fireworks or hazardous materials on the property. The grill must never be left unattended in use, and must not be used indoors, in the garage, or under the screened porch.

21. Internet and television

Internet and television are provided by third-party services. Palmetto Bay Getaway LLC is not responsible if either becomes unavailable during your stay, and will make reasonable efforts to have service restored.

22. Access

Palmetto Bay Getaway LLC may enter the property at reasonable times, with reasonable notice, to inspect it, to carry out maintenance, or to show it to prospective renters or purchasers. Where there is a reasonable belief of imminent danger to any person or to the property, it may be entered without notice.

23. Equipment and furnishings

Equipment is provided at the discretion of Palmetto Bay Getaway LLC, which makes every reasonable effort to keep it in working order. Should a non-essential item fail, no refund is due for the loss of its use. Do not remove anything from the property, do not move indoor furniture outdoors, and never use a stove, oven or range as a source of heat. Report any broken or defective equipment promptly.

24. Breakdowns and refunds

If an essential system fails — water, plumbing, electrical, air conditioning, the stove or the refrigerator — every effort will be made to repair or replace it, or an appropriate refund will be made for the inconvenience. This does not apply to a failure caused by misuse. No refund is given for a power cut or other interruption caused by weather or by circumstances outside our control, nor for inclement weather, nor for conditions at neighbouring properties.

25. If the property becomes unavailable

If the property cannot be used during the rental term for reasons beyond our control, Palmetto Bay Getaway LLC will make good-faith efforts to find a replacement of equal or greater value that is acceptable to the Lead Renter. If no such replacement is found, all payments made will be returned immediately, this agreement ends, and neither party has any further obligation.

26. Travel insurance

If you are concerned about a last-minute cancellation or an early departure, we strongly recommend that you take responsibility for that risk and buy travel insurance.

27. Falsified reservations

Any reservation obtained under false pretences is subject to forfeiture of all payments, and the party may be refused check-in or evicted.

28. Default

If the Lead Renter or the Rental Group fails to comply with this agreement, they shall surrender the property, remove their belongings, and leave it in good order. No part of the total rental fee is refunded. If legal action becomes necessary, the prevailing party is entitled to reimbursement of its costs, and the Lead Renter agrees to pay the reasonable costs, attorney's fees and expenses incurred by Palmetto Bay Getaway LLC in enforcing this agreement.

29. Risk, indemnity and release

The Lead Renter acknowledges and agrees that the property and its facilities — including the pool, the garden and the gym equipment — are used at their own risk. The property is privately owned; the owner does not assume liability for loss, theft, damage, injury or death to persons or their property. The Lead Renter agrees to indemnify and hold harmless Palmetto Bay Getaway LLC, its owners, agents, employees and contractors from any claim, cost, liability, legal fee or action arising from destruction of property, injury, illness or loss of life sustained by the Lead Renter, the Rental Group or their visitors on or about the property.

The Lead Renter and the Rental Group waive and release any claim against Palmetto Bay Getaway LLC, the owner and their successors, employees and representatives for any injury or death sustained on or near the property, including at the pool and in the gym, and agree to use those amenities entirely at their own initiative, risk and responsibility.

30. General

This agreement is the entire agreement between the parties regarding the rental of the property. Any change is void unless made in writing and agreed by both parties. It is governed by the laws of the State of Florida. The failure to enforce any provision is not a waiver of that or any other provision. If any provision is held invalid, the remainder is unaffected. Notices under this agreement are given in writing to the contact details held for each party.

Acknowledgment

Booking the property and paying for the booking constitutes acceptance of this agreement and acts as a digital signature. By booking, paying, or taking possession of the property, the Lead Renter confirms they have read and agree to the conditions and policies set out here.
